Rifle Possession - Davis

ALBANY, NY – A 35-year-old Albany man has been charged following investigations into two separate incidents, one in which a man was threatened because he is Muslim and another in which a man was chased with a firearm.    

On Tuesday, January 19, 2021 at approximately 8:30 p.m., a man walked into the Albany Police South Station to file a report. The victim told officers that while at a store in the area of Clinton Avenue and Lark Street, a man walked into the store and threatened to kill him because he is Muslim.

At approximately 10:35 p.m., officers responded to a store located in the area of Lexington Avenue and Sherman Street for reports of a man threatening an employee with a rifle. Upon arrival, the victim told officers that a man had displayed a rifle and chased him while continuing to point it at him. 

On Wednesday, at approximately 4:15 p.m., James Davis was arrested in the area of Dove Street and Hamilton Street following an investigation by members of the Albany Police Department. The United States Marshals Service also assisted in taking Davis into custody.

At this time of his arrest, Davis was also found to be in possession of a loaded Sig M400 rifle which he had concealed in his coat. Two additional firearms were recovered throughout the course of investigation. 

Davis has been charged with Criminal Possession of a Weapon 4th, Menacing 2nd and Aggravated Harassment 2nd. He was also cited for possessing an unregistered loaded rifle under the City of Albany General Ordinances. 

He was arraigned this morning in Albany City Criminal Court and released.
