About the Development Process
All development projects proposed in the City of Albany must comply with the Albany's Zoning Ordinance. The Zoning Ordinance, along with the Albany 2030 Comprehensive Plan, is the City’s guide to its future development. In cases where a unique hardship or practical difficulties make it difficult or impossible to comply with the Ordinance, exceptions or "variances" may be granted by the Board of Zoning Appeals (BZA).  The BZA also evaluates applications for Special Use Permits, Parking Lot Permits, and appeals of determinations of the Zoning Administrator, and may interpret any provision of the Zoning Ordinance.

The Commissioner of Buildings & Regulatory Compliance is the designated Administrator of the Zoning Ordinance, per the Albany City Code. All applications for development projects within the City must begin by filing a Building & Zoning Permit Application with Buildings & Regulatory Compliance.

Applications to the BZA, inclusive of the appropriate referral from Buildings & Regulatory Compliance, should be submitted to the BZA Contact located in the Department of Development & Planning.  The Planning Department is also available to provide instructions on how to file an appeal and to orient applicants to the appeals process.

ReZone Albany
The City is currently undergoing a review of its antiquated Zoning Code.  ReZone Albany is the initiative to update the City's code and produce a Unified Sustainable Development Ordinance, a streamlined, user-friendly Zoning Code, that will help direct project development to be in alignment with the City's Albany 2030 Comprehensive Plan, and other sustainable best practices.  Visit ReZone Albany for more information.
